The petitioner apprehends arrest in a case registered for the offence punishable under sections 384/504/506/34 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner demanded extortion amount of Rs.40 lacs from the informant. Learned counsel appearing for the petitioner submits that the informant, who is a lady, has lodged this false case only with a view to put pressure on the petitioner to provide another piece of land. Petitioner has filed Title suit no.169 of 2022 in which informant has been made as defendant no.1 and the suit is pending in the Court of Civil Judge I, Gaya. Moreover, no extortion amount has been given by the informant to the
Patna High Court CR. MISC. No.4183 of 2023(2) dt.09-05-2023 2/2 petitioner. Petitioner claims clean antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist class, Gaya in Vishnupad Police Station Case No. 08/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
