The petitioner is languishing in custody since 08.10.2014 in a case registered for the offences punishable under Sections 387, 435, 427, 379, 307/34 of the Indian Penal Code, 27 of the Arms Act and 17 of Criminal Law Amendment Act. It is alleged that the road construction was going on under the Prime Minister Gramin Sarak Yojna when three persons including the petitioner came on motorcycle, disclosed their identity and asked the informant to get the main contractor talk to them, then put the JCB machine on fire, resorted to fire, brought the informant and his companion to some distance after tieing them but subsequently released them. They were also demanding extortion.

No.14617 of 2015 (02) dt.01-05-2015 2/2 It is submitted by learned counsel for the petitioner that the accusation appears unreasonable that the petitioner and others disclosed their identity and even assuming the accusation no offence under Section 307 IPC is made out and after registration of the present case the petitioner has been roped in other cases. The investigation has already concluded. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Sherghati P.S.
