JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Admittedly, the informant is not an eye witness of the alleged occurrence and the persons, who have seen the alleged occurrence, could not identify the assailant and disclosed before the informant that some unknown persons committed the murder of the deceased. However, the informant suspected the involvement of the petitioners in the alleged crime on the ground that there was some dispute between the petitioners and deceased as both were engaged in business of property dealing and prior to the alleged occurrence, petitioners had given threatening and also had made attempt to commit murder of the deceased but
Patna High Court Cr.Misc. No.2605 of 2016 (2) dt.30-01-2016 admittedly, no information was given to the police regarding the aforesaid incident. Moreover, it is informed on behalf of petitioners that one co-accused, Md. Saguni having more or less similar allegation, has already been granted privilege of anticipatory bail by a coordinate bench of this court. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Musrigharari P.S. Case No. 130 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Samastipur.
