Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-12-2021 Heard Mr. Arvind Kumar Pradhan, learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Sikroul P.S. Case No. 23 of 2020 dated 21.01.2020 instituted for the offences under Sections 25(1-b)a, 26,35 of the Arms Act.

It has been alleged in the FIR that two firearm weapons were recovered from Mahendra Kumar Yadav @ Bhola Yadav and Udit Kumar Pandey. Both of them have, in their confessional statement, named the petitioner as one of their associates.

This is the basis for prosecuting the petitioner in the instant case.

Learned counsel for the petitioner has

Patna High Court CR. MISC. No.13446 of 2021(2) dt.24-12-2021 2/2 submitted that but for the confession of the two accused persons from whose possession firearm weapons were recovered, there is no other material to connect the petitioner with the offence.

The petitioner was earlier made accused in one case in which charge-sheet has not yet been submitted against him despite the fact that the case was registered in the year 2016.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Sikroul P.S. Case No. 23 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
