For the Petitioner/s : Mr. Dharmendra Kumar Paswan For the Opposite Party/s : Mrs. Veena Rani Pd.(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 3.
24-02-2016 Heard Sri Dharmendra Kumar Paswan, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the 3rd attempt for grant of bail of the petitioner in a case registered under Sections 20, 22 & 23 of the Narcotic Drugs & Psychotropic Substances Act, 1985 in Sahebganj P.S. Case no. 167 of 2012 (Sessions Trial No. 85 of 2015). Earlier, on 27-01-2016, a report was called for from the court below regarding stage of the trial, which has been received and kept at flag 'A'. On perusal of the report dated 11th February, 2016, it appears that till date, seven witnesses have already been examined. As per charge-sheet, five more witnesses are to be examined. Meaning thereby that trial is going on smoothly. In view of the fact that trial is continuing, there is no
Patna High Court Cr.Misc. No.3826 of 2016 (3) dt.24-02-2016 2/2 reason to review my earlier order.
The prayer for bail again stands rejected.
Keeping in view the fact that the petitioner is inside the jail and on third occasion his prayer for bail is being rejected, it is desirable to observe that learned trial court may take appropriate step so that the trial may come to its logical end without unnecessary delay.
