JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are said to have been caught with stolen motorcycle and are languishing in jail custody since 01.11.2015. Petitioners do not have any criminal antecedent and it appears from perusal of the impugned order that investigation of this case has already been completed but even after completion of the investigation, police could not succeed to trace out this fact as to whether the seized motorcycle is stolen property or not. Submission on behalf of the petitioners is that petitioners had gone to attend the marriage ceremony in Mirganj and after attending the marriage ceremony they had gone to watch

Patna High Court Cr.Misc. No.2078 of 2016 (02) dt.22-01-2016 2/2 a movie but they were caught by the police on mere suspicion and as a matter of fact, the seized motorcycle has not been recovered from their possession.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S.Case No. 308 of 2015.
