JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 Petitioner seeks regular bail in connection with Kargahar P. S. Case No. 454 of 2018 registered for the offence punishable under Section 394 of IPC.

As per F.I.R. there is allegation of looting the tractor and selling the same. Petitioner is not named in the F.I.R, later on, his name transpires on the confessional statement. Apart from that he is accused in four other cases also. Submission of the learned counsel for the petitioner is that so far this petitioner is concerned, except confessional statement, there is nothing against him. He is in custody for five months.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/-

Patna High Court CR. MISC. No.2121 of 2020(2) dt.16-01-2020 2/2 (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Sasaram, Rohtas, in connection with Kargahar P. S. Case No. 454 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area in the first week of for a period of six months, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.

Let a copy of this order be communicated to the S.P. Rohtas, for needful.
