Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner happens to be nephew of the deceased and according to prosecution case, the deceased had adopted the informant but petitioner and his brothers were pressuring the deceased to transfer his land to them and, when the deceased did not buckle upon the aforesaid pressure, the petitioner and his brothers committed the alleged occurrence.
Admittedly, none has seen actual killing of the deceased
Patna High Court Cr.Misc. No.1662 of 2016 (2) dt.21-01-2016 2/2 and except suspicion as well as land dispute, there appears to be nothing against the petitioner. Moreover, having more or less similar allegation, co-accused namely, Ranjan Yadav and Sunil Yadav have already been granted privilege of bail. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Asthawan P.S. Case No. 31 of 2010 to the satisfaction of Chief Judicial Magistrate, Nalanda at Bihar Sharif. (Hemant Kumar Srivastava, J) A.K.V./- U T
