Petitioner is accused in connection with Baheri P.S. Case No. 220 of 2015 registered under Sections 302 and 201/34 of the I.P.C.

The prosecution case is that the marriage of the petitioner was performed with Ganesh Poddar, uncle of the informant Pappu Kumar Poddar, but her husband Ganesh Poddar , who is mentally retired, left the village. Thereafter, petitioner started to live as wife with father of the informant, who also got executed the sale deed in favour of the petitioner Sunita Devi and he generally used to live in Delhi in connection with private job. The petitioner, in the meanwhile, developed illicit relation with co-villager Rajeev Ranjan Poddar. After knowing about the said fact, the father of the informant made protest and used to reside at his Sasural in village Chaitha. The father of informant came on

Patna High Court Cr.Misc. No.1760 of 2016 (3) dt.03-03-2016 2/2 19.10.2015 in village and on 20.10.2015, his dead body was found in orchard behind Ram Janki Mandir. The informant raised suspicion about committing murder of his father by the petitioner and Raveev Ranjan Poddar.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. and the case diary that there is no eye witness of the occurrence. The name of the petitioner has been figured in the F.I.R. by the informant mere on suspicion due to alleged illicit relation of petitioner with Rajeev Ranjan Poddar. Further, submission is that petitioner, who is lady, has no criminal antecedent and is in custody since 26.10.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Darbhanga in connection with Baheri P.S.
