====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 10-10-2022 Heard learned counsel for the petitioner and learned counsel for the Bihar Education Project Council (for brevity 'B.E.P.C.').

2. The fact is admitted that the period of petitioner's contractual existence as Junior Engineer in the Department of B.E.P.C. Muzaffarpur, has lapsed long back, i.e., on 31.03.2020. Having observed so, this Court would take notice of the submission made on behalf of the petitioner's counsel that the impugned order dated 10.04.2018, as contained in Annexure-11

Patna High Court CWJC No.14546 of 2018(3) dt.10-10-2022 2/3 to the writ petition, holds the charge of carrying out the works in an irregular manner to be proved, however, without assigning any reasons whatsoever. The relevant extract of the impugned order dated 10-04-2018, is being reproduced:- "उपररोक्त प्रततवदन एव पतत्रों कव आधधार पर मध्य तवदधालय, रघुनधाथपघुर, प्रखण्ड मघुशहरर, तजिलधा मघुजिफ्फरपघुर कव अतततरक्त वर्ग कक्ष कव तनमर्माण हवतघु तचितनहत कनरय अतभियवतधा शर तववकधानवद सव कधायर्मालय पतत्रांक 7043 तदनत्रांक 21.08.2017 दधारधा अपनधा पक्ष रखनव कधा ममौकधा तदयधा रयधा थधा। शर तववकधानवद कधा पक्ष तदनत्रांक 19.09.2017 करो प्रधाप्त हघुआ थधा। शर तववकधानवद दधारधा प्रधाप्त पक्ष एव जिजाँचि प्रततवदन कव आधधार पर इनहें दरोषमघुक्त नहह तकयधा जिधा सकतधा ह, क्यत्रोंतक इनकव दधारधा तकयव रयव अतनयतमत कधायर्ग प्रमधातणत ह। अतएव इनकधा पक्ष स्वरकधायर्ग यरोग्य नहह ह।"

The Court, from a bare perusal of the impugned order dated 10-04-2018, is of the opinion, that the order does not assign any reason nor does it show any consideration for the petitioner's reply to show cause dated 11.09.2017.The petitioner has raised various issues in his reply. However, the same has not been considered.

4. In view thereof, this Court would hold that the petitioner shall not suffer any stigma on account of the

Patna High Court CWJC No.14546 of 2018(3) dt.10-10-2022 3/3 impugned order dated 10.04.2018, and the same shall not come in the way of the petitioner's consideration for employment in future.

5. The writ application is disposed of with the observations/directions.
