Heard learned counsel for the petitioner as well as the learned APP for the State.
The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 357 of 2012, registered for the offences punishable under Sections 342, 323, 379, 406, 420, 467, 468, 471 and 34 of the Indian Penal Code. As per allegation, the petitioner was Manager of an N.G.O., Kalyan Ghar Muskan Grahak Bima Kendra, Narkatiaganj. The informant was working as agent in the
Patna High Court CR. MISC. No.13206 of 2021(2) dt.10-01-2022 2/3 aforesaid N.G.O. The informant collected money for insurance and deposited the same with the petitioner. It is further alleged that for the period from 08.02.2010 to 08.04.2011 the informant got premium from insurance policy holders and got deposited the same to the petitioner. In the meantime, the informant got information that the petitioner has not deposited the money of insurance in Divisional Office and he used to issued forged receipt in the name of the Head Office.
Learned counsel for the petitioner has submitted that he is ready to deposit the said amount which is 25,940/- . The anticipatory bail petition of the petitioner was rejected by the coordinate Bench in Cr. Misc. No. 41033 of 2018 vide order dated 28.08.2018 mentioning that the petitioner had admitted his guilt and he had also undertaken to make payment of the amount. From perusal of the order dated 28.08.2018 it appears that similar prayer has been made before the coordinate Bench which was not accepted and the anticipatory bail petition of the petitioner was rejected. I do not see any fresh ground which makes the petitioner entitled for grant of anticipatory bail. Considering these facts and circumstances, the anticipatory bail petition of the petitioner is hereby rejected.
Patna High Court CR. MISC. No.13206 of 2021(2) dt.10-01-2022 3/3 Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
