Petitioner is named in the first information report but according to the fardbeyan of the informant, five persons opened fire one by one on different parts of the body of the deceased and so far as petitioner is concerned, it is alleged that he, too, shot fire but his firing did not hit the deceased. The seizure list reveals that only five cartridges were recovered from the place of the occurrence. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Laheri P.S.
