JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Amas P.S. Case No. 302 of 2021 instituted for the offences under Section 30(a) (d) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.11.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the allegation is of recovery of 2 litres of wine and 100 kg mahua flower from the house of the petitioner.

Learned counsel for the petitioner submits that the house is a joint family property and as such petitioner was not knowing who had kept the aforesaid liquor and mahua in the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in connection with Amas P.S.
