JUSTICE MADHURESH PRASAD ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This is a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 120(B) of the Indian Penal Code. Counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.55645 of 2017 (2) dt.12-12-2017 2/3 petitioners are co-accused. The allegation of inflicting fatal blow is against co-accused, namely, Lallan Paswan. The said Lallan Paswan was granted bail vide order, dated 21.09.2017, passed in Cr. Misc. No. 41545 of 2017. The case arises out of scuffle between the parties with respect to playing of cricket. Learned Counsel for the petitioners also relied upon the fact, which has also been considered in the said order of bail, dated 21.09.2017, regarding the death of the deceased, being attributed to hematoma, due to fall or some other circumstances.

Considering the aforesaid submissions and the fact that the petitioners are in custody since 08.09.2017, the prayer for bail of the petitioners is allowed. Let the petitioners, above named, be released on bail on their furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 48 of 2017, subject to the conditions:

(i) That one of the bailors will be a close relative of the petitioners, who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.
