JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and the State. The petitioners, two in number, seek bail in Gogri (Paura) P.S. Case No. 157 of 2014 registered under section 307 IPC. The informant is the victim of the case. The allegation is that while the informant was sowing paddy in the field he found that the accused persons allowed their cattle to graze the paddy crops. On being objected, the accused persons assaulted the informant with Lathi(s). The doctor found as many as five injuries on the skull/head, three of them subsequently were opined to be grievous in nature.

The contention of the petitioner is that there is general and omnibus allegation against the petitioner who has no criminal antecedent. The petitioner is in custody since 08.01.2015.

Patna High Court Cr.Misc. No.11968 of 2015 (4) dt.02-07-2015 2/2 Learned APP, on the other hand, opposed the prayer and submitted that in course of investigation several witnesses have supported the allegation attributed to the petitioner in the crime. Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. His prayer for bail is accordingly rejected. However, the petitioner is granted liberty renew his prayer for bail after five months.
