JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the ground that informant claimed that prior to alleged occurrence, petitioner had given a call on the phone of the deceased and on the call of petitioner, the deceased left his home and subsequently, his dead body was recovered hanging from a tree.
Learned counsel, appearing for petitioner submits that except confessional statement of petitioner, there appears to be nothing against the petitioner and moreover, during entire investigation, the call details of petitioner was not verified and when the print of call details of deceased was taken out, no call of
Patna High Court Cr.Misc. No.13239 of 2015 (3) dt.07-09-2015 petitioner was found on mobile set of the deceased. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/_ (ten thousand) with two sureties of the like amount each in connection with Bairiya P.S. Case No. 115 of 2014 to the satisfaction of J.M. Ist Class, Bettiah, West Champaran.
