2. The petitioner seeks regular bail in connection with Chanpatiya P.S. Case No. 185 of 2024 registered for the offence punishable under Sections-103(1)/238, B.N.S.
3. Allegedly, marriage of daughter of the informant was solemnized with Munna Mahto. The couple had two sons aged about 10 and 8 years. As per allegation, husband of the deceased and his family members used to torture the deceased. It is further alleged that on 09-08-2024 at about 7.00 a.m. the accused persons, namely Shiv Shankar @ Bhola Mahto (father-in-law), Jag Mahto (cousin fatherin-law), Sarda Devi (mother-in-law), Mohan Patel and Ratan Mahto committed murder of the deceased by pressing her throat.
4. It has also been submitted that the only allegation

No.8060 of 2025(3) dt.08-05-2025 2/2 against the petitioner is the he along with co-accused Mankeshwar Patel, Gilli Ram, Lalji Patel, Shivpujan Mahto, Dev Pujan Mahto and 15-20 unknown persons participated in cremation of the deceased with intention to disappear the evidence. Learned counsel for the petitioner has submitted that admittedly, the petitioner is not involved in murder of the deceased. Even the recitals of the FIR are assumed to be true, then also, his role is only to participate in cremation ceremony. The petitioner is in custody since 11-09-2024.
5. Learned counsel appearing for the State has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Tusar Singh, learned Judicial Magistrate Ist Class, Bettiah, West Champaran/Successor Court in connection with Chanpatiya P.S.
