The petitioner seeks regular bail in connection with Laukahi P.S. Case No. 11 of 2021 lodged under Sections 302/201/34 of the Indian Penal Code, 1860.
It transpires from the F.I.R. that recovery of dead body of one Ramdeo Mandal was made hanging on tree. There was land dispute going on between the parties. It has also mentioned in the F.I.R. that initially a U.D. case bearing no. 06/2020 was lodged and thereafter upon complain of informant, the present case has been lodged under Section 302 of I.P.C. with other sections.
Learned counsel for the petitioner submits that due to
Patna High Court CR. MISC. No.2866 of 2022(2) dt.08-06-2022 2/2 land dispute, all the accused persons have been implicated in this case in which he is languishing in jail since 24.08.2021. He also submits that charge sheet has already been filed in this case. He further submits that a Co-ordinate Bench of this Hon'ble Court has granted bail to other co-accused, namely, Bihari Mandal in Cr. Misc. No. 30736 of 2021 vide order dt. 25.10.2021 and Usha Devi vide order dt. 25.05.2022 passed in Cr. Misc. No. 70858 of 2021.
Learned A.P.P. has opposed the prayer for bail. Considering the facts of the case and after perusal of records as well as this aspect that charge sheet has already been submitted and petitioner is in judicial custody since 24.08.2021 as well as two similar situated co-accused were granted bail by the Co-ordinate Bench of this Hon'ble Court, let the petitioner above named, be granted bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IIIrd, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 11 of 2021.
