JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Fatehpur P.S. Case No. 223 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 307, 332, 338& 353 of the Indian Penal Code.
Petitioner happens to be a member of a mob.
Although, petitioner is named in the first information report with allegation that he along with more than 150 persons blocked the road in protest of death of a person and when police party reached there, they have been assaulted but no specific overt act has been attributed against the petitioner. Petitioner does not have any criminal antecedent.

No.1422 of 2020(2) dt.27-02-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Fatehpur P.S. Case No. 223 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C.
