2. The petitioner apprehends his arrest in connection with Sohsarai P.S. Case No. 303 of 2025 dated 07.10.2025 registered for the offences punishable under sections 115(2), 126(2), 304(2), 74 and 3(5) of the Bharatiya Nyaya Sanhita and sections 8 and 12 of the POCSO Act.

As per the prosecution story, the informant has alleged that on 07.10.2025 at about 11:30 A.M., when her daughter (victim) was going to school, Chandan Kumar Yadav (petitioner), along with 3-4 other persons, closed the victim's mouth and snatched her gold earrings. It is further alleged that the accused persons dragged the victim along the road and also

4. Learned counsel for the petitioner submits that the petitioner's family and the informant's family are next door neighbours and in between them, there are several cases and in the present matter, they have entered into a compromise and good relation has been restored in between them and the compromise petition has also been filed before the trial court. It is lastly submitted that the informant has fabricated a false story and the alleged offences of the POCSO Act are not applicable in the present matter.
5. Learned counsel for the informant submits that there is serious allegation against the petitioner and he has no information about any restoration of cordial relation in between both the parties.
6. Learned APP for the State submits that there is serious allegation against the petitioner and the main alleged offences are not compoundable.
7. Considering the seriousness of the allegations appearing against the petitioner, which relate to outraging the modesty of a minor girl and further, the case is under investigation and the petitioner has one criminal antecedent
Patna High Court CR. MISC. No.8414 of 2026(2) dt.24-02-2026 3/3 pertaining to Sohsarai P.S. Case No. 189/2024, earlier lodged by the victim's family against the petitioner, in my opinion, it is not a fit case for anticipatory bail to the petitioner. Accordingly, his prayer stands rejected.
