JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel for the informant. Petitioner seeks regular bail in a case registered for the offences under section 363, 366-A and 376 of the Indian Penal Code.

Statement of the victim has been recorded under section 164 of the Code of Criminal Procedure, 1973 in which she stated that she was kidnapped by the petitioner and his associates and after that she was raped by the petitioner. The victim happens to be a minor girl and, therefore, I am not inclined to release the petitioner on bail at least at this stage.

Accordingly, prayer for bail of the petitioner in

Patna High Court Cr.Misc. No.2403 of 2016 (2) dt.27-01-2016 connection with Madhubani Town P.S. Case no. 279 of 2015 pending in the court of the learned 1st Additional Sessions Judge, Madhubani stands rejected.
