The petitioner seeks bail in Sour Bazar (Police Shivir Baijnathpur) P.S. Case No. 331/2018, instituted for offences under Section(s) 302, 201, 120(B), 34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner has been made accused in this case merely on suspicion. Petitioner is father of second wife of deceased. It is mentioned in para 9 of bail petition that earlier this petitioner had lodged Saharsa Sadar P.S. Case No. 527/2016 for the offences under Sections 363 and 366 of the Indian Penal Code against the deceased Bipin Prasad Yadav (husband of informant) for kidnapping his daughter.

It is alleged in the written report that husband of informant had performed second marriage with the daughter of

Petitioner was not happy with aforesaid marriage and had attempted to kill the husband of informant but any how he could save himself. Earlier also a case was filed at Saharsa Sadar P.S. against this petitioner for damaging the motorcycle of deceased. It is further alleged that informant got information on 03.06.2018 that her husband has been shot dead. The informant raised suspicion that this petitioner might have killed her husband.

Learned counsel for the petitioner has submitted that besides suspicion there is nothing against this petitioner. Petitioner is in custody since 07.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Police Shivir Baijnathpur) P.S. Case No. 331/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
