2. After some argument Mr. Raj Nandan Prasad, learned counsel for the petitioner prays for and is permitted to withdraw this application with liberty to raise all the points at the stage of framing of charge.

3. If any discharge application is filed by the petitioner then the same shall be considered by the Special Judge in accordance with law and in view of the judgment of the Hon'ble Supreme Court passed in the case of Kanchan Kumar Vs. State of Bihar reported in (2022) 9 SCC 577.
