JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 06-02-2019 The petitioner, who has been appointed as ANM and has been posted at Chorahi Centre, seeks her transfer to Primary Health Centre, Babhangama in Barauni on the ground that her husband is posted as teacher in Barauni.

2. It has further been submitted that because of her posting at Chorahi Centre which is about fifty kilometer away from her place of residence, she is not able to look after her family which comprises her husband and two small children. A representation has been made by the petitioner to that effect which has not been acted upon/responded.

3. The learned counsel for the petitioner submits

Patna High Court CWJC No.1950 of 2019 dt.06-02-2019 2/2 that in view of a general direction of the Department of Personnel that a working woman be preferably placed/posted at the place of posting of her husband, such direction or the guideline ought to have been followed while posting the petitioner.

4. Under the aforesaid circumstances, the petitioner is directed to make a fresh representation before the Civil Surgeon-cum-Chief Medical Officer, Begusarai (respondent No. 4) within a period of four weeks from today who, on receipt of such representation, shall look into all the relevant facts and would pass necessary orders within a period of eight weeks thereafter.

5. With the aforesaid direction, the writ petition is disposed off.
