JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-03-2019 The present case is a second attempt on behalf of the petitioner for grant of regular bail in connection with Balrampur P.S. Case No. 108 of 2016 dated 03.10.2016, giving rise to S.T. No. 08 of 2017 for the offences punishable under sections 302, 120(B)/34 of the Indian Penal Code.

This Court had called for a report from the learned trial court and the learned Additional Sessions Judge-III, Katihar vide letter dated 11.2.2019 has submitted a report wherein it has been stated that in the connected trial 12 prosecution witnesses, out of 10, have been examined and only two witnesses are remaining to be examined, hence, three months' time is likely to be consumed for conclusion of the trial.

I have heard the learned counsel for the petitioner, who could not point any change in the circumstances from the

Patna High Court CR. MISC. No.3387 of 2019(3) dt.13-03-2019 2/2 time the petition of the petitioner seeking grant of regular bail was withdrawn on 17.5.2018, till date. This Court further finds that a serious allegation has been levelled against the petitioner of having killed his wife.

Having considered the gravity of the offence alleged to have been committed by the petitioner herein as also the fact that there is no change in the circumstances, this Court does not find any occasion to entertain the present petition, hence, the same is dismissed.
