JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although petitioner is not named in the first information report but from perusal of the impugned order, I find that petitioner was caught with the stolen motorcycle and allegedly confessed his guilt.
Submission on behalf of the petitioner is that petitioner had purchased the said motorcycle from one Ram Pukar Mahto, son of Radhika Charan Mahto of villege Sohpur, P.SBikram, District- Patna and, as matter of fact, at the time of purchasing the said motorcycle, petitioner was not aware that the seized motorcycle was stolen property. It is further submitted that petitioner does not have any criminal antecedent and is
Patna High Court Cr.Misc. No.5451 of 2016 (2) dt.15-02-2016 2/2 languishing in jail custody since 20.10.2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Dulhin Bazar P.S.Case No. 153 of 2015.
