Seen the report submitted by the learned lower court wherefrom, it is evident that matter is lingering for charge. That being so, now the evidences having adduced in accordance with Section 244 Cr.P.C is to be taken up for consideration, the prayer having at the end of the petitioner for quashing of the order dated 07.12.2007 gone behind curtain.

However, petitioners will be at liberty to raise the plea
