The petitioner seeks bail in Gurua P.S. Case No. 20 of 2011, registered for the offence punishable under Sections 147, 148, 149, 435, 341 and 323 of the Indian Penal Code, section 17 of the CLA Act and sections 13, 16, 18 and 20 of Anti Law Prevention Act.
As per prosecution case, 25 to 30 extremists having armed with weapons came and surrounded the informant and caused damage of his articles worth Rs. 7,10,000/-. It is submitted on behalf of the petitioner that petitioner is not named in the FIR and he has falsely been implicated in this case merely on suspicion. Name of this petitioner transpired in this case on the basis of confessional statement of co-accused. No incriminating article has been
Patna High Court CR. MISC. No.2441 of 2022(2) dt.24-03-2022 2/2 recovered from possession of this petitioner. Till date petitioner has not been put on test identification parade. Petitioner is in custody since 18.10.2021.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sherghati, Gaya in connection with Gurua P.S. Case No. 20 of 2011.
