The petitioner seeks bail in connection with Piyar P.S. Case No.112 of 2017 registered under Sections 272, 273 and 414 of the Indian Penal Code besides Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
The accusation is that in course of checking of the vehicle, a red colour car bearing Registration No.WB-02V-2233, which was being driven by Chhotu Kumar, was apprehended and, on search, 14 cartoons, containing 336 bottles, each containing 375 ml. Indian Made Foreign Liquor, were recovered. That car was being escorted by two persons, boarding on the motorcycle,
Patna High Court Cr.Misc. No.62323 of 2017 (2) dt.21-12-2017 2/2 out of which, one was apprehended, who disclosed his name as Vageesh Kumar alias Shalu, who disclosed about purchasing of the aforesaid liquor from the petitioner.
Learned counsel appearing on behalf of the petitioner submits that while the house of the petitioner was searched but no incriminating article was recovered. Thereafter, the petitioner was apprehended by the police and the police got recorded his confessional statement showing his involvement in two other cases, as detailed in paragraph-3 to this application, in which the petitioner is on bail. In the present case, the petitioner is in custody since 23.11.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur, in connection with Piyar P.S. Case No.112 of 2017..
