The petitioners are languishing in custody since 03.01.2015 in a case registered for the offences punishable under Sections 366A, 370A, 373/34 of the Indian Penal Code and 9.10 and 11 of the Child Marriage Prohibition Act. It is alleged that preparation was going to get the minor girl married.
It is submitted by learned counsel for the petitioners that the FIR was registered on 02.01.2015 then girl was
Patna High Court Cr.Misc. No.9814 of 2015 (02) dt.19-03-2015 2/2 apprehended and her 164 Cr.P.C. statement was recorded on 05.01.2015 where she stated that she was not married and wrong information was given to the police.
A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the 164 Cr.P.C. statement of the victim girl, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 04 of 2015.
