The petitioner is accused in connection with Sessions Trial No. 16 of 2014 arising out of L.N.M.U. P.S. Case No. 88 of 2012 registered under sections 324, 326, 307/34, 302, 120(B) and 34 of the I.P.C. pending in the Court of 2nd Additional Sessions Judge, Darbhanga.
Learned counsel appearing on behalf of the petitioner submits that prayer for bail of the petitioner was rejected twice on merit vide order dated 03.04.2014 and 29.07.2015 passed in Cr. Misc. No. 42354 of 2013 and 29079 of 2015 respectively by this Court. The petitioner is in custody since 18.12.2012, but the trial has not yet been concluded.
On perusal of the report as received vide Letter No.
Patna High Court Cr.Misc. No.5462 of 2016 (3) dt.09-03-2016 2/2 87 dated 27.02.2016, it appears that the case was fixed on 01.03.2016 for framing of the charge and it is expected that the trial of the petitioner will be concluded within one year. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner. Accordingly, the application is rejected. However, Trial Court is directed to conclude the trial of the petitioner preferably within a period of one year by taking all efforts.
