JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-04-2018 The only grievance of the petitioner is that while he was in jail custody he had been assaulted by an inmate of the Jail so much so that he had to be hospitalized in the Hospital. He is apprehending threat to his life if he is sent back to prison. On this ground alone he is seeking release even before completing the sentence.
While this Court would not be inclined to grant any such relief allowing the petitioner to be released before completion of the sentence, this Court would certainly direct the Jail authorities to take all care of safety and security of the petitioner if
Patna High Court Cr. WJC No.2471 of 2017 (3) dt.13-04-2018 2/2 he is sent back to Jail.
The Jail Superintendent shall take care that the petitioner is not left in a situation where he may be attacked by the prisoners for any reason and in case any such attack takes place it will be the personal responsibility of the Jail Superintendent and he will be proceeded against.
The Writ Application stands disposed of.
