2. The petitioner apprehends his arrest in a case registered under Section 283/379 of the Indian Penal Code and Section 4/40 of the Bihar Mining Act and 188 of the Motor Vehicles Act.
3. As per F.I.R., this petitioner and other accused persons were involved in cutting the soil without having any valid license. Some tractors and JCB were seized. Petitioner is owner of one of the seized JCB.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case only because petitioner is owner of one of the seized JCB. Similarly situated several co-accused
Patna High Court CR. MISC. No.5187 of 2025(3) dt.11-02-2025 2/2 persons have already been granted bail by this Court and other co-ordinate Benches of this Court vide orders dated 25.02.2020, 30.01.2021 and 26.10.2021 passed in Cr. Misc. Nos. 1744 of 2020, 26826 of 2020 and 33065 of 2021respectively.
5. Learned A.P.P. for the State opposed the prayer for bail.
6. Having considered the fact that similarly situated several co-accused persons have already been granted bail, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Darbhanga, in connection with Bahadurpur P.S. Case No. 562 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
