JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Madanpur P. S. Case No. 11/2014 registered for offences punishable under sections 461, 411, 379 of the Indian Penal Code. The accusation is of committing theft of mobile sets and other articles from the shop of the informant by the petitioner. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. and on the basis of the written report of one Neeraj Singh, F.I.R. was lodged against unknown persons under Sections 461 and 379 of the I.P.C. regarding committing theft of mobile and other electronic

Later on, the police seized the theft mobile sets from tempo in which the petitioner was found sitting. In fact the petitioner was passenger in the tempo and only on suspicion, he has been implicated in this case and he is in custody since 10.12.2014.

Considering the facts and circumstances, the above named petitioner, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection of Madanpur P.S.Case No. 11 of 2014.
