Petitioner seeks regular bail in a case registered for the offences under section 302, 201/34 of the Indian Penal Code.
Petitioner happens to be son of the deceased and, according to the prosecution case itself, deceased was a drunkard. Moreover, the informant claims that on the alleged date of occurrence deceased came in drunkard state and thereafter he was assaulted by the petitioner and his brother Vidhyanand Rai. It is an admitted fact that Vidhyanand Rai after full fledged trial has been acquitted vide Sessions trial No. 171 of 2014 by judgment and order dated 23.09.2014.
Patna High Court Cr.Misc. No.2430 of 2016 (2) dt.27-01-2016 Taking note of the facts and circumstances of the case as well as submissions of the parties, petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 110 of 2013.
