The petitioner is languishing in custody since 29.07.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
It is alleged against the petitioner that he caused injury with Garasa on the head of his younger brother's wife(Bhavo).
It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow hence, the case does not come within the purview of Section 307 of the I.P.C. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
