JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bairiya P.S. Case No. 318 of 2019, G.R. No. 3862 of 2019 for the offenses under Sections 25(1-B)1,26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 3.11.2019. Nothing was recovered from the conscious possession of the petitioner and his name surfaced on confessional statement of co-accused.

Considering the fact that the petitioner has no criminal antecedent, his name surfaced on confessional statement and nothing was recovered from his possession, let
