2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 448, 307, 337, 379, 504, 506 of the Indian Penal Code.

3. The case of prosecution is that on 22.11.2023 the petitioner along with other accused persons came and started assaulting to the informant and his father as well as his brother. In the alleged occurrence, the informant along with his family members sustained injuries.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The specific allegation of

Patna High Court CR. MISC. No.5114 of 2024(2) dt.07-02-2024 2/2 assaulting is against co-accused Nivas Kumar and Sonu Kumar. This petitioner is only member of mob and there is general and omnibus allegation of assaulting against him. The present case is nothing but the counter blast of Muffasil P.S. Case No. 394 of 2023. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 28.11.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muffasil P.S. Case No. 395 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Nawada.
