2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 74, 76, 352, 351 ( 2 ) (3) and 3 (5) of BNS.

3 . The prosecution case , in brief, is that informant alleged that when informant was alone at her home , petitioner came and misbehaved with her and tried to outrage her modesty , upon protest petitioner also assaulted her. It is further alleged that other co-accused persons also came there and assaulted her.

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged.

Patna High Court CR. MISC. No.1630 of 2026(2) dt.28-01-2026 2/2 Petitioner is father-in -law of the informant. There is delay of 2 days in lodging the present F.I.R. which creates doubt over the entire prosecution case . Though , there is allegation of assault against this petitioner but there is no injury report on record to substantiate the allegation . Rest of the allegations are ornamental in nature to make the case grave . Petitioner claims clean antecedent.

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Araria in connection with Palasi P.S. Case No. 321 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
