JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-07-2018 The petitioner seeks quashing of the FIR pertaining to Rampur P.S. Case No. 234 of 2017 dated 25.07.2017 instituted for the offences under Sections 135 and 138 of the Indian Electricity Act.

Learned counsel for the petitioner has submitted that the electric connection was in the name of the father of the petitioner and after the disconnection of the electric line, only the wires had not been removed and only for that the petitioner has been made accused in this case.

The prosecution, in the present case, is with

Patna High Court Cr. WJC No.1714 of 2018(2) dt.23-07-2018 2/2 respect to unauthorized consumption of electricity which has got nothing to do with the electric line/connection given to the father of the petitioner.

The nature of accusation in the FIR do not make out a case for quashing of the same.
