The petitioner is seeking anticipatory bail in connection with Chhatapur P.S. Case No. 156 of 2018 registered under Sections 379 & 34 of the Indian Penal Code. Learned counsel for the petitioner submits that on perusal of the seizure list it would appear that the bag which was snatched from the informant has been recovered from the house of one Rupesh Kumar Bahardar. Learned counsel submits that so far as this petitioner is concerned, his name has transpired in the confessional statement of the said accused. It is submitted that the petitioner has no criminal antecedent and has been falsely implicated in the present case.

Patna High Court Cr.Misc. No.4046 of 2019(2) dt.04-02-2019 2/2 opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case and place of recovery as also that petitioner has no criminal antecedent, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IV, Supaul, in connection with Chhatapur P.S. Case No. 156/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
