JUSTICE AMARESH KUMAR LAL ORAL ORDER 20-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b) a, 26 and 35 of the Arms Act.

The allegation is that on information the informant went to the house of Binod Mehta (father of the petitioner) and from his bed one country made revolver and six cartridges were recovered. Binod Mehta disclosed that the arms and ammunitions were of the petitioner.

It is submitted by the learned counsel for the petitioner that no arms and ammunitions were recovered from the conscious possession of the petitioner. The arms and ammunitions were recovered from the bed of Binod Mehta, who has already been granted bail vide Cr. Misc. no. 13995 of 2014. Learned counsel for the State submits that Binod Mehta is the father of the petitioner and he disclosed that the

Patna High Court Cr.Misc. No.13115 of 2015 (4) dt.20-07-2015 2 / 2 arms and ammunitions belonged to the petitioner. The petitioner has also criminal antecedent and after investigation the case has been found true.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Mrs. Sulekha Jha, Judicial Magistrate, Ist Class, Munger, in Kashim Bazar P. S. Case no. 206 of 2013 after framing of charge with the following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned court concerned.
