2. The petitioner seeks regular bail in connection with Bihiya P.S. Case No. 252 of 2023 registered on 07.10.2023 lodged under Sections 366A of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against four named accused persons including the petitioner.

4. Counsel for the petitioner submits that alleged victim has been recovered and she has narrated the statement under Section 164 Cr.P.C before the learned Magistrate that she has left her home on her own free-will with the petitioner and the content of the Statement has been acknowledged by the Sessions Judge in the rejection of bail order of the petitioner.

5. Counsel further submits that petitioner is innocent

Patna High Court CR. MISC. No.4991 of 2024(2) dt.07-02-2024 2/2 and has committed no offence. He further submits that petitioner is in custody since 08.10.2023 having clean antecedents.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur in connection with Bihiya P.S. Case No. 252 of 2023.
