The petitioner seeks bail in a case registered for the offences punishable under Sections 364, 201 and 120B of the Indian Penal Code.
The informant named the petitioner along with other accused persons and alleged that the accused persons kidnapped his son Danish Rabbani @ Sonu Lal and killed him on account of enmity.
Learned counsel for the petitioner submits that prior to lodging of this FIR, the informant lodged informatory petition, Sanha, but the informant did not name the petitioner during the course of investigation. Co-accused Nishat @ Nishat Alam @ Nishant Alam named the petitioner as one of the kidnapper of the
Patna High Court Cr.Misc. No.12569 of 2015 (2) dt.29-07-2015 2/2 victim, but except that none of the witnesses has disclosed the participation in the aforesaid kidnapping and murder of Danish Rabbani @ Sonu Lal. Co-accused Nishat @ Nishat Alam @ Nishant Alam and Isteyak @ Tinku @ Isteyak Hussain have already been enlarged on bail vide orders passed in Cr. Misc. Nos. 18166 of 2015 and 20625 of 2015 on 20.07.2015. The learned APP did not dispute the facts.
It appears that except the name of the petitioner figured in the confession of Nishat @ Nishat Alam @ Nishant Alam who has already been enlarged on bail there is no material on record. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Learned Additional Sessions Judge, Kishanganj in Sessions Trial No. 104 of 2015, arising out of Kishanganj P.S. Case No. 438 of 2014.
