JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 This is an application for grant of anticipatory bail in connection with Sikandra P.S. Case No. 79 of 2018, disclosing offences under Sections 498(A), 304(B)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner, who happens to be the husband of the deceased, is of dowry death of the deceased. Submission of learned counsel for the petitioner is that as a matter of fact while preparing food sari of the deceased had caught fire and due to that she died and the dead-body was found inside the kitchen and half part of the body. Learned counsel for submitted that materials collected during course of investigation that the petitioner was at Bangaluru at that time and the allegation is false and concocted against the petitioner. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Sikandra P.S.
