Petitioner, who is in custody seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Section 25(1-b) a, 26, 35 of Arms Act.

Informant who is the police officer has alleged in his self statement that on receiving specific information that miscreants have assembled to commit some grave crime, he raided the place from where five miscreants including the petitioner was apprehended and on search of petitioner one country made pistol with two live cartridges were recovered from him.

It has been submitted on behalf of petitioner that

Patna High Court CR. MISC. No.3805 of 2020(2) dt.21-01-2020 2/2 petitioner has no criminal antecedent and has been implicated in this case on account of police high handedness. Petitioner is in custody since 04.10.2019.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, the petitioner is granted liberty to renew the prayer for bail after completing six months of custody in jail. (S. Kumar, J) veena/- U T
