The petitioner seeks bail in a case registered for the offence under Sections 379, 382, 411, 307, 326, 34 of the Indian Penal Code.

As per the F.I.R., this petitioner and co-accused Abhishek Raj @ Raja were caught stealing the motorcycle of friend of informant, whereas, one miscreant managed to flee away. It is also alleged that all the three accused persons assaulted the informant and his friend with master key, due to which, they sustained some injuries.

Petitioner denies the allegation and submits that during investigation, no injury report has been brought on record by the prosecution in respect of injury sustained by informant and his friend, as alleged in the F.I.R. Petitioner is in

Patna High Court CR. MISC. No.2810 of 2022(2) dt.25-03-2022 2/2 custody since 17.11.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Trial No. 1738 of 2021, arising out of Muzaffarpur Sadar P.S. Case No. 643 of 2020.
