JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two paragraphs of the case diary have been referred by learned Sessions Judge in the impugned order. The learned Sessions Judge referred paragraph-150 of the case diary to show the involvement of the petitioner in the alleged crime but Para150 of the case diary reveals that petitioner is said to be seen near the place of occurrence and another paragraph referred by the learned Sessions Judge is para-169 of the case diary which shows the criminal antecedent of the petitioner. Admittedly, nothing has been recovered from conscious possession of the petitioner nor he has been put on T.I.P.
Accordingly, let the petitioner, above named, be
Patna High Court Cr.Misc. No.16595 of 2015 (4) dt.10-09-2015 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul in connection with Kiul Rail P.S.Case No. 69 of 2014.
