JUSTICE SHIVAJI PANDEY ORAL ORDER 05-04-2019 It appears that the prayer for bail of petitioner nos.1 and 3 has already been rejected vide order dated 22.01.2019. Heard learned counsel for the petitioner nos. 2 and 4 and learned counsel for the State.
In this case, the petitioner nos. 2 and 4 are seeking anticipatory bail in connection with Bela P.S. Case No. 178 of 2018, registered for the offence punishable under Sections 304 (B), 201/34 of the Indian Penal Code.
Allegation has been made that the marriage of the sister of the informant was solemnized with the petitioner no.1, namely, Harendra Patel three years ago and out of that wedlock,
Patna High Court CR. MISC. No.2737 of 2019(5) dt.05-04-2019 2/2 two children were born. Thereafter, all the accused persons demanded dowry and due to non-fulfillment of demand of dowry, she had been killed and they tried to disappear her dead body, but the police recovered the dead body of the victim from the side of the river, however, it appears from the case diary that the witnesses have seen the accused persons taking away the dead body of the deceased and the body was found by the side of the river.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner nos. 2 and 4. Accordingly, their prayer for bail is rejected. However, if the petitioner nos. 2 and 4 surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
