JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-10-2024 Though the present writ petition has been filed for quashing the encroachment proceedings, initiated by the Circle Officer, Dawath, District-Rohtas at Sasaram, appertaining to the plot, situated at Mauza-Parmanpur, Thana No.448, Khata No.123, Khesra No.1005, vide Encroachment Case No.4 of 2019-2020, however, at the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 12.12.2019, passed by the Circle Officer, Dawath, in Encroachment Case No. 4 of 2019-2020, under
Patna High Court CWJC No.760 of 2020(4) dt.23-10-2024 2/2 Section 6(1) of the Bihar Public Land Encroachment Act, 1956, by filing appropriate appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956, however, seeks some protection during the interregnum period. Liberty so sought is granted.
2. It is needless to state that for a period of six weeks from today, status quo, existing as on today, qua the land/house of the petitioner in question, shall be maintained in order to enable him to file appropriate appeal and seek interim relief.
3. The writ petition stands disposed off on the aforesaid terms.
